Kook Entertainment ("Kook", "we", "us", or "our") respects your privacy and is committed to handling personal data responsibly and in accordance with applicable data-protection requirements.

This Privacy Policy explains what personal data we may collect, why we use it, how it may be shared, how long we may retain it, and the rights available to you.

This Privacy Policy should be read together with our Terms of Service.

This Privacy Policy applies when you:

  • visit or use the Kook website;
  • create or use a customer account;
  • place a rental or purchase Order;
  • request delivery, pickup, or setup services;
  • communicate with Kook by email, telephone, WhatsApp, website forms, or other channels;
  • subscribe to marketing communications; or
  • otherwise interact with Kook where personal data is collected.

Where consent is required for a particular type of processing, Kook will seek that consent separately where appropriate. Merely reading this Privacy Policy does not replace any consent that may be required under applicable law.

2. Personal Data We May Collect

Depending on how you interact with Kook, we may collect the following categories of personal data:

2.1 Identity Data

This may include your first name, last name, Emirates ID, passport, visa information where applicable, date or evidence of age where required, and other identification information you provide.

2.2 Contact Data

This may include your billing address, delivery address, email address, telephone number, WhatsApp number, and other contact details.

2.3 Order & Transaction Data

This may include details of rental and purchase Orders, Items ordered, rental dates and times, delivery and pickup information, deposits, refunds, Additional Fees, invoices, transaction references, and Order history.

2.4 Communication Data

This may include emails, WhatsApp messages, customer-support requests, feedback, complaints, photographs or videos submitted in connection with an Order, and other correspondence with Kook.

2.5 Account & Profile Data

This may include account information, saved preferences, Order history, communication preferences, feedback, and other information associated with your customer profile.

2.6 Technical & Usage Data

This may include your IP address, browser type, device type, operating system, approximate location derived from technical information, website activity, referral source, pages viewed, timestamps, and similar technical information generated when you use the Site.

2.7 Marketing & Advertising Data

This may include your marketing preferences, interactions with marketing communications, advertising identifiers, campaign interactions, and information collected through analytics or advertising technologies where permitted.

3. How We Collect Personal Data

3.1 Directly from you

We may collect personal data when you:

  • create an account;
  • place an Order;
  • provide identification for a rental;
  • contact customer support;
  • send photographs or videos relating to rental or product issues;
  • request a return, refund, cancellation, or rental extension;
  • subscribe to communications; or
  • otherwise provide information directly to Kook.

3.2 Automatically

Certain technical and usage information may be collected automatically when you visit the Site through cookies, pixels, server logs, analytics technologies, and similar tools.

3.3 From service providers

We may receive information from providers that help us operate our business, including our e-commerce platform, payment providers, delivery or courier providers, analytics providers, advertising platforms, and customer-service tools.

4. How We Use Personal Data

We may process personal data where reasonably necessary to:

  • create and manage customer accounts;
  • process and fulfil rental and purchase Orders;
  • verify identity and age where required for rentals;
  • arrange delivery, pickup, and setup services;
  • manage rental Deposits, refunds, Additional Fees, and outstanding balances;
  • process returns, cancellations, replacements, and rental extensions;
  • provide customer service and respond to inquiries;
  • communicate important information about an Order or service;
  • prevent fraud, misuse, unauthorized transactions, or loss of rental Items;
  • protect customers, Kook personnel, property, systems, and business operations;
  • maintain accounting, financial, operational, and legal records;
  • establish, exercise, or defend legal rights or claims;
  • comply with applicable laws and lawful requests;
  • maintain and improve the Site and customer experience;
  • understand website usage and business performance; and
  • provide marketing or advertising where permitted and subject to applicable preferences or consent requirements.

5. Lawful Processing

Kook processes personal data with your consent where consent is required under applicable law.

Personal data may also be processed without consent where permitted by applicable UAE law, including where processing is reasonably necessary to:

  • perform an agreement or Order with you or take steps at your request before entering into one;
  • comply with legal obligations applicable to Kook;
  • establish, exercise, or defend legal rights or claims;
  • protect your interests or other rights where permitted by law;
  • prevent or investigate fraud or unlawful activity where permitted; or
  • meet another lawful basis or exception recognized under applicable data-protection law.

Where Kook relies on consent, you may withdraw that consent where permitted. Withdrawal does not affect processing that was lawful before the withdrawal or processing that Kook is otherwise legally permitted or required to continue.

6. Emirates ID, Passport & Rental Verification

For rental Orders, Kook may request identification such as an Emirates ID, passport, or visa information where reasonably necessary for identity verification, age verification, fraud prevention, rental handover, account security, or the protection of rental Items.

Kook will seek to limit the collection and retention of identification information to what is reasonably necessary for these purposes.

6.1 Retention of ID copies

Where Kook retains a copy or image of identification, we aim to delete it after the rental Order has been fully completed, the rental Deposit has been resolved, and there is no outstanding dispute, loss, damage claim, unpaid balance, fraud concern, or other legitimate reason requiring continued retention.

Where an unresolved issue exists, relevant identification information may be retained for as long as reasonably necessary to investigate or resolve the matter, establish or defend legal claims, comply with lawful requests, or satisfy applicable legal requirements.

7. Payment Information

Payments are processed through the payment services made available at checkout.

Kook generally does not receive or store your complete payment-card number. Payment details are handled by the relevant e-commerce and payment-processing providers in accordance with their own systems, security standards, and privacy practices.

Kook may receive transaction information such as payment status, transaction references, payment method type, refund information, and other information reasonably necessary to administer an Order.

8. When We May Share Personal Data

Kook does not sell your personal data as a standalone business activity.

We may share personal data with employees, contractors, professional advisers, and service providers where reasonably necessary for the purposes described in this Privacy Policy.

These recipients may include:

  • E-commerce and hosting providers that operate or support the Site and Order systems;
  • Payment providers that process transactions and refunds;
  • Delivery, courier, and logistics providers where needed to fulfil Orders;
  • Customer-service and communications providers used to communicate with customers;
  • Analytics and advertising providers where permitted by applicable law and relevant privacy or cookie settings;
  • IT, security, and technical-service providers that help operate or protect Kook's systems;

We seek to provide service providers only with the information reasonably necessary for the relevant service and require appropriate confidentiality or data-protection safeguards where applicable.

9. International Transfers

Some of Kook's technology, e-commerce, payment, analytics, communications, or other service providers may process personal data outside the United Arab Emirates.

Where personal data is transferred outside the UAE, Kook will seek to ensure that the transfer is carried out in accordance with applicable UAE data-protection requirements.

Depending on the circumstances, this may include transferring data to a jurisdiction providing an appropriate level of protection, using contractual or other appropriate safeguards, obtaining consent where legally appropriate, or relying on another transfer mechanism permitted under applicable law.

10. Data Retention

Kook retains personal data only for as long as reasonably necessary for the purposes for which it was collected or as otherwise permitted or required by applicable law.

Retention periods may depend on the type of information and why it is required.

  • Rental identification: retained only for as long as reasonably necessary for rental verification, Order completion, Deposit resolution, disputes, legal claims, fraud prevention, or applicable legal requirements.
  • Order and transaction records: may be retained for accounting, tax, audit, fraud prevention, warranty, customer-service, dispute, and legal purposes.
  • Customer accounts: account and Order information may remain within Kook's e-commerce systems while the account is active and for an appropriate period afterwards where necessary.
  • Customer communications: may be retained where reasonably necessary to manage Orders, resolve disputes, provide support, or maintain appropriate business records.
  • Marketing information: may be retained until you withdraw applicable consent, unsubscribe, or the information is no longer reasonably required, subject to any necessary suppression record used to respect your opt-out.

Where appropriate, personal data may be securely deleted or anonymized when it is no longer required.

11. Data Security

Kook uses reasonable technical, organizational, and administrative measures designed to protect personal data against unauthorized access, disclosure, alteration, loss, destruction, or misuse.

Measures may include access controls, secure systems, appropriate authentication, restricted access to customer information, and security measures provided by the technology platforms used by Kook.

No electronic system or method of transmission can be guaranteed to be completely secure. Accordingly, while we take reasonable steps to protect personal data, absolute security cannot be guaranteed.

15.1 Abandoned checkout reminders

Where supported by our e-commerce platform and permitted by applicable law, Kook may send limited reminders relating to an incomplete checkout.

16. How to Opt Out of Marketing

You may ask Kook to stop sending marketing communications at any time by:

  • using an unsubscribe option included in the communication where available;
  • emailing info@kook.ae; or
  • contacting Kook through our Contact page.

Opting out of marketing does not prevent Kook from sending necessary service communications relating to an Order, rental, payment, Deposit, delivery, pickup, return, refund, security issue, or other customer-service matter.

17. Your Personal Data Rights

Subject to applicable UAE law and any lawful exceptions, you may have rights relating to your personal data, including the right to:

  • obtain information about how your personal data is collected and processed;
  • request access to personal data relating to you;
  • request correction of inaccurate or incomplete personal data;
  • request deletion of personal data in circumstances where the applicable legal requirements are met;
  • request restriction or cessation of processing in circumstances provided by law;
  • object to direct-marketing processing, including related profiling where applicable;
  • withdraw consent where processing is based on your consent;
  • request transfer of your personal data to you or, where technically feasible and legally applicable, to another controller;
  • object to certain automated decisions where applicable; and
  • submit a complaint to the competent UAE data-protection authority where you believe your rights have been infringed.

The Kook Site may contain links to third-party websites, applications, payment providers, social-media platforms, or other services that Kook does not operate.

Those third parties may have their own privacy policies and practices. Kook is not responsible for how an independent third party processes personal data after you leave the Kook Site or choose to use that third party's service.

We encourage you to review the relevant privacy information before providing personal data to third-party services.

19. Children's Privacy

Kook Orders and customer accounts are intended for persons aged 18 or over.

Minors may use rental gear only under the supervision and responsibility of an adult in accordance with our Terms of Service.

Kook does not intentionally collect personal data directly from children for the purpose of allowing them to place Orders independently.

If you believe a child has provided personal data to Kook without appropriate authorization, please contact us so that we can review the matter.

20. Changes to This Privacy Policy

Kook may update this Privacy Policy from time to time to reflect changes to our services, technology, business practices, or applicable legal requirements.
