It is Kook’s policy to respect your privacy regarding any information we may collect while operating our Site. This Privacy Policy applies to https://www.kook.ae (hereinafter, “Kook”, “we”, “us”, or “our”). We respect your privacy and are committed to protecting personal information you may provide through the Site.

This Privacy Policy explains what information we may collect on our Site, how we use it, and under what circumstances we may disclose it to third parties. This Privacy Policy should be read together with our Terms of Service posted on our Site.

By accessing or using the Site and/or purchasing or renting equipment from it, you confirm that you have read, understood, and accept this Privacy Policy. If you do not agree with any part of this Privacy Policy, you should discontinue use of the Site and our services.

2) Personal Data We May Collect

We may collect, use, store, and transfer different kinds of personal data about you. We group it as follows:

  1. Identity Data: Emirates ID or passport, visa (where applicable), first name, last name, title, and other identifiers you provide.
  2. Contact Data: billing address, delivery address, email address, telephone number(s), and other communication details you provide.
  3. Transaction Data: details about purchases/rentals, payment confirmations/references, refunds, deposits, and communications related to orders.
  4. Communication Data: messages, emails, WhatsApp communications, support requests, and other correspondence with Kook.
  5. Technical Data: IP address, browser type/version, time zone setting, device and operating system information, and other technology used to access the Site.
  6. Profile Data: account details, orders, preferences, feedback, and survey responses (where applicable).
  7. Marketing Data: your preferences in receiving marketing, communication preferences, and interactions with our marketing communications. This may also include information collected via advertising/analytics tools when you view our ads (e.g., IP address, referrer, browser information, timestamp).

3) How We Collect Your Data

  • Directly from you: when you create an account, place an order, communicate with us, submit forms, or provide ID for rentals.
  • Automatically: through cookies and similar technologies when you browse our Site (see Cookies section).
  • From service providers: such as Shopify (our e-commerce platform), payment providers (Stripe/Tabby), and delivery partners, to the extent needed to provide services.

4) Why We Use Your Data (Purposes)

We process personal data for the following purposes:

  • to verify identity for rentals and security purposes (including age verification);
  • to process orders/rentals and provide our services;
  • to arrange pickup/delivery, confirm shipping/delivery, and issue invoices/receipts;
  • to manage deposits, refunds, additional fees, and outstanding balances;
  • to provide customer support and respond to inquiries;
  • to prevent fraud, protect our business, and secure our Site;
  • to operate, improve, and analyze our Site performance (analytics);
  • to send service communications (e.g., order confirmations, updates);
  • to send marketing communications by email or SMS where you have opted in or where permitted by law, and to provide personalized content/advertising (see Marketing section).

5) Legal Bases for Processing

We process personal data on one or more of the following bases, as permitted under applicable UAE law:

  • Contractual necessity: where processing is required to perform a contract with you (e.g., fulfilling an order/rental).

6) Emirates ID / Passport Copies (Rentals)

For rentals, we may collect and keep a copy/photo of your Emirates ID or passport/visa (where applicable) for identity verification, fraud prevention, deposit protection, and dispute handling.

Deletion of ID copies: We aim to delete ID copies once the rental is completed and the deposit is refunded, provided the order is fully closed and there is no dispute, damage claim, missing item, unpaid balance, or related issue. If an issue arises, we may retain the ID copy for the duration of the dispute window and/or as required to pursue or defend legal claims (including litigation) or to comply with lawful requests.

7) Information Relating to Payments

We require certain payment information to process payments. We do not store or save your full payment card details (such as credit/debit card numbers). Payments are processed through payment providers (e.g., Stripe and/or Tabby) and Shopify in accordance with their systems and security standards.

8) Disclosure of Information

Kook may disclose potentially personally-identifying and personally-identifying information only to those of its employees, contractors, and service providers that:

  • (i) need to know that information in order to process it on Kook’s behalf or to provide services available on our Site; and
  • (ii) are subject to confidentiality and/or data protection obligations.

We may share your personal data with:

  • Platform providers (e.g., Shopify) to host and operate the Site and orders;
  • Payment providers (e.g., Stripe, Tabby) to process payments and refunds;
  • Delivery partners/couriers and/or in-house drivers to fulfill delivery/pickup (as applicable);
  • Analytics/advertising providers (e.g., Google and Meta tools) to measure performance and improve marketing (see Cookies/Marketing);
  • Professional advisers (e.g., lawyers, accountants) where necessary; and
  • Authorities where required by subpoena, court order, or lawful governmental request, or when we believe disclosure is reasonably necessary to protect the rights or property of Kook, third parties, or the public.

9) International Transfers

Some of our employees, contractors, and service providers may be located outside the UAE or may process data in other countries (for example, where Shopify, payment providers, or analytics providers operate internationally). By using the Site and providing your information, you acknowledge that your information may be transferred and processed outside your country of residence as described in this Privacy Policy.

10) Data Retention

We retain personal data only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including providing services, maintaining business records, complying with legal obligations, resolving disputes, and enforcing our agreements.

  • Rental ID copies: kept only during the active rental and any applicable dispute window, then deleted once the order is fully closed and deposit is refunded, unless needed for disputes/legal claims or lawful requests.
  • Order records: typically retained for accounting, audit, fraud prevention, and customer support purposes for a commercially reasonable period, and as required by law.
  • Account/contact details: if you have an account, Shopify may retain certain account/order details as part of the platform operation. We will delete or anonymize data where reasonably possible upon your valid request, subject to legal and operational requirements.

11) Security

The security of your personal information is important to us. We take reasonable administrative, technical, and physical safeguards designed to protect your personal data against unauthorized access, use, alteration, or destruction. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security.

12) Cookies and Similar Technologies

We use cookies and similar technologies to provide a better user experience, to keep the Site functioning properly, to understand how the Site is used, and to support marketing and advertising. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites, products, or services.

17) Children’s Privacy

Our services are intended for users aged 18 and above. We do not knowingly collect personal data from children.
